If you are looking to start a business, you can now register your business online via the Companies Commission of Malaysia's (SSM) ezBiz.

Businesses that can be registered under SSM

According to SSM, the business includes every form of trade, commerce, craftsmanship, calling, profession, or other activity carried on for the purposes of profit but does not include any office or employment or any charitable undertaking or any occupation defined in the schedule under the provisions of the Business Registration Act 1956 (ROBA 1956).

In addition to the business of selling goods or food, other services such as freelance services are also covered under the businesses that can be registered under SSM.

However, ROBA 1956 only covers businesses operating in West Malaysia, covering the peninsula and the Federal Territories.

Under SSM, there are two types of businesses:

  • Sole Proprietorship: the business is wholly owned by an owner.

  • Partnership Business: a business owned by a minimum of two (2) persons and not more than twenty (20) partners.

What do you need to register your business?

  • To be the owner of a business, you must be a Malaysian Citizen or a Permanent Resident.

  • The owner must be at least 18 years old.

  • Only owners or partners can register their business.

Here are other conditions and guidelines:

  • New business registration is only valid for one year and does not exceed five years on each registration.

  • Even if the business is registered with SSM, owners must obtain licences, permits or approval letters from relevant authorities to operate.

  • Anyone that carries on business without registering commits an offence under ROBA 1956. If convicted, they are liable to a fine not exceeding RM50,000 or imprisonment for a term not more than two years, or both.

Registering business name

  1. You may register your business using your personal name or a trade name.

  2. If your business name uses the personal name stated in the IC, you will not need to apply for the business name. For instance: Ruslan bin Mohamad, Ramasamy a/l Mutusamy

  3. Trade Name is the name of the proposed business. You must obtain prior approval from the Registrar of Business. For instance: Kedai Dobi Lucky, Mewah Star Catering, or APS Unggul Enterprise.
