Private Sector Employee Charged with Using Fake MCs

A private company employee was charged with three counts of using fake sick leave certificates in February and March 2019. At the Ampang Magistrate's Court, Mohamad Amir Khan Mohamed Yusof, 23, pleaded not guilty to all the charges read before Magistrate Haslinda A. Raof.

Mohamad Amir was accused of having fraudulently used three documents, particularly fake government medical certificates with the serial numbers AB 765432, AB 765398 and AB 797962.

He was accused of committing the offences at Malaysia Transformer Manufacturing Sdn Bhd, MTM Riverside Pernec Building, Jalan AU3 / 1 Ulu Kelang, Selangor, on  4th February, 15th February and 21st March.

The charge was filed under Section 471 of the Penal Code which is punishable under Section 468 of the same Act which imposes a maximum jail term of seven years and also a fine, upon conviction. Prosecutor DPP Raihanah Abd Razak did not propose bail.

However, the accused's lawyer, Kelvinder Singh Sidhu, requested for one on the grounds that his client was the sole breadwinner of his family.

"My client is still unmarried and has family members who depend on him," he said. The court allowed bail at RM9,000 for all charges with one surety and fixed July 5 for mention of the case.

In Malaysia, fake medical certificates (MCs) are rife and widespread. In April, The Star reported that the police arrested six for their involvement in a syndicate selling fake medical leave certificates (MC). They found 216 doctor's stamps, 4,631 MC slips, 257 MC booklets and receipt books.

In May 2019, the Deputy Health Minister said that the Malaysian Medical Council has the right to suspend or dismiss any medical practitioner found to be involved in the sale of fake MCs.

He added that it would be an offence if medical doctors issued MCs without medically screening their patients and they were also at risk of being removed from the list of medical practitioners.

In 2017, two men including a student were detained over making and selling fake medical certificates (MC) using the name of the Peringgit Health Clinic and the doctors stationed there and reaping RM10,500.

In 2016, there's even a syndicate selling fake MCs on social media for RM30 per MC delivers them through PosLaju within a day. Customers are asked to deposit RM30 into an account, which is owned by a proxy, and then text to a mobile number with the required number of days and the preferred illness on the MC.
